A better idea for the DOJ and Apple

Dump the wrote, replace it with a subpoena, issued to Timmy and his chief crypto engineer, by name.  They can be required to produce evidence for inspection.  So, they bring their lap to, DOJ brings the  terrorist phone, and the judge demands Timmy demonstrate this grave burden on Apple. At the very moment, the DOJ attorney grabs the phone, and hands it off;suddenly dropping the case. Thd security gage is opened.  Apple can sue later for theft, hey will have the judge as a witness.  They win, bur what are thir damages?  Unmeasurably zero.  Look, the Apple guy tried to intercept, he just missed, the DOJ assistant nabbed it, great play, Apple should be proud.
