Obamacare insurance companies payouts still not legal

I might remind everyone of the lawsuit the Republicans filed claiming that Congress never authorized the executive branch to make payouts to insurance companies based on Obamacare losses.

The claim is still valid, Trump continues to do it.  But it is a class action suppression of the Constitution and subject to a lawsuit by any citizen.  Why hasn't any lawyer taken this up? This is a million dollar legal prize, almost a sure thing and a class action to boot.
