They do not have any Constitutional fortitude for this.
If the fetus is human then it can be a dangerous human for the woman, and she has the right of self defense. If that bothers the state, then the state can take the human into custody in their fetus farm.
It is simple Constitutional law, but the Supremes have long since forgotten about the Constitution.
