A series of court decisions has created the “California Rule.” It means that once a public employee receives a pension benefit it can never be reduced unless that employee receives something of equal or greater value. It is the main hindrance to reigning in soaring pension costs that are eating up municipal budgets and causing city officials to become pension providers that offer a few services on the side.
He has no basis to change the rule, nor doe the Cal Supreme court. It is legally valid, agreed to by all parties and implied in the pension contracts. Jerry is and was a lousy lawyer in a state with no legal traditions. Our only resource is either accept the law, or make shit up legally. One other avenue is the US Supremer Court and get the Dills Act thrown out.
But letting Jerry Brown act as a body of law is a nightmare once the child molester gets the governorship. California is basically screwed with no body of law, the freedom of states rights and having rejected the rulings of the US Supreme Court already. Too late, Jerry, you frigged things up too bad to be repaired.
