On what basis can citizen's redefine state boundaries?
“no new States shall be formed or erected within the Jurisdiction of any other State … without the Consent of the Legislatures of the States concerned as well as of the Congress.”
Says the paper. Where does it say a State Court can impede the process, division is mentioned, it is a right. The state legislature can explicitly veto the idea, have they?
The state court tempts the US Supremes. The referendum process is state guaranteed, and its denial, ex ante, is a federal violation, sorry. The vote should go forward, if the legislature disagrees, fine.
The division supporters would do well to pursue the rights angle at the federal court. This is a long line of illegal intrusions into reserved rights, in California. This example, win or lose, will better sort things.
