Voluntary contract between merchant and card company

American Express AXP, +1.06%  won a Supreme Court case this week that will prohibit merchants from giving customers incentives to use credit cards that aren’t made by American Express.

If the merchant does not like the extra cost, then decline the agreement with AmEx, do not accept their cards at all.
