To wit:
My public nuisance tort claim has first priority on oil fees, my sufferings of over 40 extra hot hours a year supersedes states rights. I demand the State relinquish my tort payments first from of any oil tax, or otherwise cede me the right to send the sheriff into oil companies and any other defendant to the original tort claim, including Sierra Club for forest fires, California transit planners for co2 belching useless trans rail.
The original class action suit includes any person who currently mostly walks. I suggest many non members of the pedestrian group start walking, now, and get in on the negotiations. I expect the government will settle for a slightly higher temperature for a lower, but immediate payment to us.
I have already spent my money on a round trip to Cancun, and the tort fees were extraordinary, almost not worth it. One has to do nothing for three years before affording a plane trip.
Damages are rated per hour, but not by minimum wage since the pedestrian usually adjusts the local routine, at the determined cost, partial to effect. From where I am, that is about one round trip to Cancun, every three to five years, by my standard Green calculator.
